Description

Having been noticed from the trial Court in the suit vide T.S. No. 43 of 1977, the defendant Nos. 1 to 3 contested the same by filing their joint written statement denying the allegations alleged by the plaintiff against them taking their stands that, the suit of the plaintiff is not maintainable under law. The plaintiff has no cause of action to bring the suit. The suit of the plaintiff is hit under Section 11 of the C.P.C. and the notice under Section 80 of the C.P.C. issued by the plaintiff against them is not legal, valid and sufficient.
