Description

The trial Court held that the plaintiff is a registered Public Trust and is exempted from operation of the provisions of the Act, 1961. The trustees of the plaintiff are entitled to institute the claim on its behalf. The defendant is in arrears of rent since 01.01.2010 and his tenancy has been duly terminated by the plaintiff w.e.f. 31.03.2010 by issuance of registered notice dated 02.02.2010. The said decree has been affirmed in appeal having been preferred by the defendant by the appellate Court which also rejected an application under Order 6 Rule 17 of the CPC preferred by defendant for amendment of his written statement and an application under Order 41 Rule 27 of the CPC for taking additional documents on record.
