Description

From the evidence of P.W. Nos. 4, 5 & 7 it is abundantly clear that they have specifically admitted that they have not witnessed the incident in question and therefore by no stretch of imagination they can be termed as eye-witnesses to the incident and their evidence is of no help to the prosecution. So far as the evidence of P.W.13 is concerned we have already referred that his evidence was recorded subsequent to the statement of the appellant under Section 313 Cr.P.C. of the Indian Penal Code
